Immediate Removal of Roadside Stalls from Right Way of National Highway
The Deputy Commissioner cum Chairperson of District Highway Safety Task Force (DHSTF), West Jaintia Hills has directed the immediate removal and shifting of roadside stall, shops, vending units and other commercial activities, operation within the Right of Way of the National Highway 40E/206 located at 217th Km from Ch:216,060.00 to Ch:216,540.00 m.
The District Administration has observed that roadside vending and commercial activities are being carried out within the ROW of the said stretch of the national Highway. Such activities are causing obstructions to vehicular traffic, posing serious risk to public safety and hampering the routine maintenance and operation of the National Highway.
The direction has been issued in accordance with Clause 3(c) of the Hon’ble Supreme Court of India’s Order in Suo Motu Writ Petition (Civil) No. 9 of 2025 & W. P. (C) No. 1100 of 2025 dated 13.04.2026, which prohibits the construction, operation, or continuation of any Dhaba, eatery, or commercial structure within the Right of Way of any National Highway.
The Deputy Commissioner has directed all concerned roadside stall owners, shopkeepers, vendors and other commercial establishments operating within the ROW of the said stretch road to remove or shift their roadside stalls or shops from the National Highway’s Right of Way to a safe location outside the road reserve within 48 hours of receipt of notice.
The District Highway Safety Task Force (DHSTF) will take necessary action for removal of the encroachment without any further notice in case of non-compliance within the stipulated period. Such removal will be carried out at the risk and cost of concerned encroachers, in accordance with the applicable rules and guidelines.
The Deputy Commissioner has appealed to all concerned to comply with the direction within the stipulated time and extend full cooperation with the authorities.
